(A) The absence of a stable matrimonial relationship reducing the basis for terminating prosecution.

(B) The absence of a subsequent statement under Section 164 CrPC regarding the original FIR.

(C) The failure of the accused to challenge the territorial jurisdiction of the trial court.

(D) The inability of the prosecution to establish the exact date on which the marriage occurred
Telegram post media 2. The Supreme Court’s reliance on K. Kirubakaran v. State of Tamil Nadu (2025) was primarily significant because:

(A) It established that marriage retrospectively validates an offence involving a minor.

(B) It treated every prosecution arising from elopement as legally incapable of continuation.

(C) It recognised the relevance of subsequent matrimonial circumstances while considering substantive justice.

(D) It held that Section 482 CrPC cannot be exercised after commencement of criminal proceedings.
Telegram post media Q1. Which of the following best captures the principal basis on which the Supreme Court interfered with the criminal proceedings?

(A) The subsequent marriage automatically extinguished every offence alleged against the accused.

(B) The continuation of prosecution, in the circumstances, amounted to an abuse of the process of law.

(C) The minority of the girl was legally irrelevant once she expressed consent before the Court.

(D) The offences alleged against the accused were compoundable by mutual agreement of the parties.

The Supreme Court considered whether criminal proceedings arising from the alleged elopement of a minor girl ought to continue when the parties had subsequently married and established a stable family life. The case arose from an FIR lodged on June 1, 2020, alleging that Ayyub Malik had enticed away the complainant’s 17-year-old daughter, Shehzadi. The parties subsequently married on September 25, 2020, according to Muslim rites, and had a child together. During proceedings under Section 164 of the Code of Criminal Procedure, Shehzadi stated that she had married voluntarily, was happy in the marriage, and wished to live with her husband.

The allegations attracted provisions relating to kidnapping, wrongful concealment or confinement of a kidnapped or abducted person, and aggravated sexual offences, along with provisions of the POCSO Act. The High Court declined to exercise its inherent jurisdiction to quash the proceedings, observing that the girl was a minor when the alleged offence occurred and that the factual issues required determination at trial. The matter thereafter reached the Supreme Court.
